1Acceptance of Terms

By creating an account or using Kimochi.fun (the "App" or "Services"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms form a binding legal agreement between you and GEN A LIMITED ("we," "us," or "our"), a company incorporated in Hong Kong.

2Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this age requirement. If you are between 16 and 18, you confirm that you have reviewed these Terms and that your use is permitted under the laws of your jurisdiction.

We do not knowingly allow users under 16 to access the Services. If we discover that a user is under 16, we will terminate the account and delete associated data promptly.

3Account Registration

• You must provide accurate and current information when registering.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access at: support@gena.studio
• One person may maintain only one account. We reserve the right to terminate duplicate accounts.

4Description of Services

Kimochi.fun is an AI-powered companion platform that allows users to interact with virtual characters through multiple engagement modes. Services include:

• Chat — Text conversations with AI companion characters
• AI Image — AI-generated images featuring your companion
• Video — Dynamic motion clips and visual content
• Game — Interactive game sessions with companions
• Companion Creation — Design and create custom AI companions
• Missions — Engagement challenges that reward Gems upon completion
• Additional features — We may introduce new content types, interaction modes, and experiences over time; these will also be powered by Gems and subject to these Terms

All characters on the platform are fictional AI personas. They are not real people, and interactions with them do not constitute relationships with real individuals.

5Gems — Virtual Currency

5.1 What Are Gems?

Gems are Kimochi's virtual currency used to access features within the App. Gems have no monetary value outside the App and cannot be exchanged for cash, transferred to other users, or used on any other platform.

5.2 Purchasing Gems

• Gems are purchased in packages at prices displayed in the App at the time of purchase.
• Bonus Gems may be included in certain packages as a promotional benefit; bonus amounts are subject to change.
• All Gem purchases are final and non-refundable, except where required by applicable law.
• Gems are delivered immediately upon successful payment.

5.3 Earning Gems

Gems may also be earned by completing in-app missions and engagement activities, subject to daily limits and availability.

5.4 Gem Expiry and Forfeiture

• Gems do not expire while your account remains active.
• Upon account termination — whether initiated by you or by us — all remaining Gems are forfeited without refund.
• We reserve the right to modify, adjust, or discontinue the Gem system with reasonable notice.

5.5 No Refund Policy

5.6 Chargebacks

Initiating an unauthorized chargeback or payment dispute may result in immediate account suspension, termination, and forfeiture of all Gems. We reserve the right to pursue recovery of disputed amounts and any associated fees.

6Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Impersonate any person, entity, or public figure
• Attempt to manipulate the AI to produce content that violates these Terms or our content policies
• Reverse engineer, decompile, or extract any part of the App's source code, AI models, or systems
• Use automated tools, bots, or scripts to interact with the App or generate content
• Attempt to gain unauthorized access to the App or its underlying infrastructure
• Share, sell, or commercially exploit AI-generated content from the App without our prior written permission
• Use the App in any unlawful, harmful, deceptive, or abusive manner
• Create accounts under false identities or to circumvent a previous ban

7Content and AI Interactions

7.1 Nature of AI Content

All companion characters and AI-generated content (text, images, video, game output) are produced by artificial intelligence. Content does not reflect the views or opinions of any real person, and the AI is not a substitute for professional advice of any kind.

7.2 Not a Mental Health Service

The App is not a therapy, counseling, medical, or crisis intervention service. If you are experiencing a mental health emergency, please contact a qualified professional or emergency service in your area.

7.3 No Guarantee of Accuracy

AI-generated content may be inaccurate, inconsistent, or unexpected. Do not rely on it for factual, medical, legal, or financial decisions.

7.4 Content You Submit

When you submit inputs (messages, descriptions, preferences) to the App:

• You retain ownership of your original text inputs.
• You grant us a non-exclusive, worldwide, royalty-free license to process and use your inputs to operate and improve the Services.
• You represent that your inputs do not violate any third-party rights or applicable laws.

8Intellectual Property

All App content, AI models, characters, visual assets, features, and technology are owned by GEN A LIMITED and protected by applicable intellectual property laws. You may not copy, modify, distribute, publicly display, or create derivative works from any App content without our express written permission.

9Prohibited Content

The following is strictly prohibited:

• Any attempt to generate sexual content involving minors. Violations will result in immediate and permanent account termination and may be reported to law enforcement.
• Content designed to threaten, harass, or harm real individuals.
• Attempts to use the AI to produce instructions for violence, self-harm, dangerous substances, malware, or other harmful content.
• Content that promotes hate or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.

10Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in harmful conduct. You may delete your account at any time through Settings → Delete Account.

Upon termination:

• Your right to use the App ceases immediately.
• All remaining Gems are forfeited without refund.
• Provisions of these Terms that by nature survive termination will remain in effect.

13Indemnification

You agree to indemnify and hold harmless GEN A LIMITED, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or any content you submit.

14Governing Law and Disputes

These Terms are governed by the laws of Hong Kong. Any disputes arising from these Terms or your use of the App shall be resolved exclusively by the courts of Hong Kong.

15Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notice or email at least 14 days before the new Terms take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
